Love Your OCT Guarantee Terms and Conditions of Return

1. The Customer has the option to rent a SPECTRALIS or SPECTRALIS SPIRIT (the Equipment) directly from Heidelberg Engineering Ltd. (Heidelberg) over a term of 18 months, or lease/hire purchase the Equipment via Performance Finance Limited (Performance Finance), a third party finance provider, over a term of five years.
2. If the Customer chooses to rent the Equipment directly from Heidelberg, the Customer must enter into Heidelberg’s standard terms and conditions of rental (the Rental Agreement).
3. If the Customer chooses to lease/hire purchase the Equipment via Performance Finance, the Customer must sign a letter agreement with Heidelberg (the Letter Agreement) which incorporates and attaches Heidelberg’s amended terms and conditions of sale, as well as a lease/hire purchase agreement with Performance Finance (the Lease/Hire Purchase Agreement) governing the lease/hire purchase of the Equipment and monthly payment terms.
4. In either case, the Customer will not own the Equipment, but will have the right to use it in accordance with its intended use.
5. Heidelberg provides a warranty for the Equipment for the initial 18 month period of the Letter Agreement or the term of the Rental Agreement, as set out in Heidelberg’s terms and conditions of rental / sale, as applicable.
6. The Customer will be required to make payment either directly to Heidelberg in accordance with the Rental Agreement or to Performance Finance in accordance with the Lease/Hire Purchase Agreement.
7. The Customer may terminate either the Rental Agreement on expiry of the term or the Letter Agreement on expiry of the initial 18 month period, provided at least 3 months’ prior written notice is provided to Heidelberg.
8. On termination of either agreement, the Equipment must be in full working condition and free from any defects (whether functional or aesthetic).
9. Heidelberg may in its absolute discretion refuse to accept early termination of the Letter Agreement if it considers (in its sole opinion) the Equipment to be damaged or faulty. Termination of the Letter Agreement is not permitted after the expiry of the initial 18 month period.
10. As set out in the Rental Agreement, Heidelberg may charge the Customer any costs and expenses incurred by Heidelberg in repairing the Equipment following termination of the Rental Agreement.
11. On expiry of the 3 month notice period, notwithstanding any provisions to the contrary in the Rental Agreement, Heidelberg will de-install and remove the Equipment from the Customer’s premises free of charge (other than the cost of any necessary repairs, as set out in paragraph 10 above) on the condition that, at such time, the Customer has made all the payments due under the Rental Agreement or the Letter Agreement and is not otherwise in breach of the Rental Agreement or the Letter Agreement.
12. Performance Finance are authorised and regulated by the Financial Conduct Authority. Heidelberg is an Introducer Authorised Representative of Performance Finance.
